What is and what is not constitutional in the United States of America has changed over time for two major reasons. First, Constitutional Amendments modified the Constitution. Second, the Supreme Court has done its Constitutional duty of determining what is and is not constitutional.

WHY HUMANS CANNOT USE RELIGION TO JUDGE OTHERS:
Quoting Neil deGrasse Tyson, an American astrophysicist: “There are as many atoms in a single molecule of your DNA as there are stars in the typical galaxy. We are, each of us, a little universe.” Without knowing all there is to know about each atom, in each universe of atoms in each molecule of someone's DNA, RNA, and GENOME makeup, it is just impossible to fairly judge that person. Even if one knew all of those things, they would also need to know every chemical and every environmental factor the person had ever been exposed to, along with any adverse reactions to those exposures, in order to judge them fairly. In addition, they would also need to be aware if the person carried any autosomal recessive condition from even further back in their family tree. It is obvious that humans just don't have enough information judge others fairly.
